Terms of Service
This document is a template provided for reference and should be reviewed and adapted by qualified legal counsel before you rely on it or publish it at launch.
1. Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of the DineoTech restaurant-management platform, websites and related services (together, the "Service"), operated by DineoTech ("DineoTech", "we", "us" or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a restaurant or organization, you represent that you are authorized to bind that entity.
2. Description of the service
DineoTech is a software-as-a-service platform that helps restaurants run their operations, including QR scan-and-order menus, a point-of-sale and waiter dashboard, kitchen tickets (KOT) and billing, taxes and discounts, reservations, inventory, loyalty, reporting and multi-outlet management. DineoTech is a technology provider only; it does not operate your restaurant, prepare food, or process card payments on your behalf.
3. Accounts and security
- You must provide accurate account information and keep it up to date.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account and staff logins.
- Notify us promptly of any unauthorized use or suspected security breach.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent or harmful purpose.
- Attempt to gain unauthorized access to the Service or other users' data.
- Interfere with, disrupt or overload the Service or its infrastructure.
- Reverse-engineer, copy or resell the Service except as expressly permitted.
- Upload malicious code or content that infringes the rights of others.
5. Subscriptions and plans
The Service is offered across plans (including a free tier and paid tiers). Paid plans are billed in advance on a recurring basis for the applicable billing period. Fees, features and limits for each plan are described at the point of purchase or in your order. We may change plan pricing on a prospective basis with reasonable notice. 6. Intellectual property
The Service, including its software, design, trademarks and content (excluding your data), is owned by DineoTech and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain all rights to the data and content you submit to the Service.
7. Data and privacy
Our handling of personal information is described in our Privacy Policy. You are the controller of the customer and business data you process through the Service and are responsible for obtaining any necessary consents and for complying with applicable data-protection laws.
8. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or free of harmful components.
9. Limitation of liability
To the maximum extent permitted by law, DineoTech will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill. Our aggregate liability arising out of or relating to the Service will not exceed the amounts you paid to DineoTech for the Service in the twelve (12) months preceding the event giving rise to the claim.
10. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or if required by law. Upon termination, your right to use the Service ceases; we will make your data available for export for a reasonable period as described in our policies before deletion.
11. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, for example by posting the updated Terms and revising the "last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to applicable law, the courts located in India will have jurisdiction over any disputes arising from these Terms or the Service.
